A man who allegedly raped a woman with a mild form of Down's syndrome knew he had HIV when the supposed crime took place, according to the crown.

Serge Levac, 47, is accused of raping a woman last October. The woman has a Down's syndrome, and while she can live on her own, she needs supervision.

Levac is charged with aggravated sexual assault, death threats and weapons possession.

The victim was scheduled to testify Monday, but the crown said she was not well enough.

She is slated to testify on Thursday.

The case

The two lived in the same building in Little Burgundy. Police and witnesses say Levac knocked on her door and convinced her to let him in. That's when the alleged rape took place.

The woman only notified her supervisor a few days later. The social worker then called police, who arrested Levac.

When they learned he was HIV positive, they released his picture to the public in case there were other victims who were equally as vulnerable due to physical or mental conditions.
