MONTREAL - The Labour Relations Commission has turned down a request from the CSN labour union to order the Couche-Tard convenience store chain to reopen one of its stores.
The CSN argued that Couche-Tard closed the store to prevent workers from unionizing.
The Confederation of National Trade Unions had filed an application for an interim order to reopen the store at the corner of Jean Talon and Iberville. The case was heard Tuesday.
In his decision, administrative judge Jacques Vignola said because the closure is real and permanent, the case law is clear: the Commission cannot order the reopening.
Judge Vignola also rejected the CSN's request that rather than reopen the store, that it order the chain to rehire employees who lost their jobs in another one of its facilities.
The Commission argued that such a measure could be suitable if a closure was unfair or illegal. However, it judged that there is no reason to make such an order at this point
