Dany Villanueva is likely to be deported from Canada.

The 24-year-old, who is the older brother of Fredy Villanueva, fatally shot by police in 2008, will likely be extradited to his birthplace of Honduras.

Villanueva is a permanent resident of Canada, not a citizen, and has been faced with the prospect of deportation since he spent 11 months in jail for armed robbery in 2006. He has been living in Quebec since the age of 12, when his brother and sisters immigrated to Canada. His parents had moved to the country three years prior.

A deportation order was issued in April 2010 following several convictions for crimes including robbery, unauthorized possession of a prohibited weapon and failure to follow probation orders.

Villanueva was most recently arrested for impaired driving, possession of narcotics and breach of parole on April 15, 2010 in Repentigny.

He is also suspected of having links to street gangs.

Villanueva had appealed the extradition order, arguing his safety would be compromised in Honduras, but the courts denied the appeal.

Villanueva now has three last-ditch efforts to remain in the country: he may seek a judicial review of the decision, he may send an application to Immigration Canada, or Villanueva's counsel may seek a risk assessment of his home country.

Dan Bohbot, president of the Quebec Immigration Lawyers Association, said the chances Villanueva will be able to remain in the country are now slim.
