A man injured after getting run over in an altercation with a Montreal taxi driver faced a tough cross-examination Tuesday afternoon at the trial of Montreal cabbie Guercy Edmond.

Benoit Kapelli, 25, suffered a perforated bladder and several broken ribs after being run over by Edmond, who is charged with assault and dangerous driving and fleeing the scene of an accident, following the April 29, 2012 incident.

A graphic video shot by one of Kapelli's friends was showed at trial Tuesday, revealing images of Kapelli shoving the cabbie while some of his co-passengers stomped on the hood and roof of the cab.

Prosecutor Josiane Laplante  claimed that Edmond intentionally ran over Kapelli but Edmond claimed that he was simply attempting to flee attackers.

The incident began when Edmond picked up three passengers at around 3 a.m. at St. Laurent near Rachel. A violent argument broke out after Kapelli complained that Edmond failed to set the meter back to zero. The customers disembarked and the melee began.

Edmond’s lawyer Yves Vaillancourt told the court Tuesday that Edmond was already nervous for his safety, as the incident took place during a time of massive student protests in Montreal. Edmond felt threatened and said that he never saw Kapelli when he ran him over. Soon after he approached a police officer to alert him of the incident.

"As soon as Mr. Edmond crossed paths with a police officer, he told them people were after him," Vaillancourt said. "Even when he was there with police officers (at the scene), they were still attacking the car."

Vaillancourt reminded the judge that despite others swarming and striking Edmond's car, his client is the only one who has been charged.

Several dozen protesters came to the courthouse on May 2, 2012 to chant "free Guercy," following the arrest. The trial is expected to last through Friday.

Edmond is a 50-year-old father of two who moved to Canada from Haiti in 1991. Kapelli is originally from France and told the court that he works as a pilot.
