Ducarme Joseph, the apparent target of a gangland shooting last month in Old Montreal, has been sentenced to ten months in jail.

Joseph was arrested last month following a breach of his bail conditions related to an attack last year at a restaurant on St. Laurent.

On September 9, 2009, he was seen attacking the doorman of Buona Notte Restaurant with a champagne bottle, a metal stick, plates and food.

The restaurant and the victim refused to co-operate with police, but officers seized security tape to press their case.

Joseph was arrested and charged, but as part of his release on bail conditions he was supposed to refrain from associating with certain individuals.

Following his arrest, he quickly pleaded guilty to breaking bail conditions, seeing as how one of those individuals he was supposed to stay away from was killed in the attack at the Flawnego boutique on March 18, 2010.

Judge worried about revenge

Joseph was arrested the next day for breaking bail conditions, but while kept in jail, the judge was worried Joseph was plotting revenge against his alleged attackers.

In court Monday, Joseph stunned all by pleading guilty to the outstanding charges of assault, and of possessing a gun silencer, and was sentence to ten months.

He also agreed to stay out of several downtown clubs following his release, such as Buona Notte, the Globe bar/restaurant, Suco Lounge, Copacabana and the W Hotel.

Police say Joseph used intimidation and extortion at those locations.

The plea means prosecutors cannot keep Joseph in jail indefinitely.

"I have to suggest a sentence for the crime he's convicted of, and not what he will and will not do," said prosecutor Anne-Marie Otis.

With good behavior, Joseph could be out of jail as early as this July.
