A 28-year-old Laval resident has been charged with fleeing the scene of a crime and the hit and run death of a 74-year-old man.

Michael Del Giacco, of Vimont, appeared in court Wednesday afternoon where he was granted bail. He had to pay a $5,000 security and promise not to drive until at least his next court date.

Prosecutors allege that on Monday morning Del Giacco was leaving the drive-through of a McDonald's on Laurentides Blvd. near Dagenais Blvd. when he ran over Claude Comte and Louiselle Lemieux Comte, then sped off.

Comte, 75, did not survive the crash. Lemieux Comte suffered minor injuries and has been released from hospital.

Officers spotted Del Giacco's 2006 Mercedes ML500 Tuesday morning as he was commuting, not far from where the deadly crash took place. He was arrested, his car seized, and the vehicle is being subjected to an examination by police.

Del Giacco's next court appearance is scheduled for Jan. 22, 2014.
