The Director of Criminal and Penal Prosecutions in Quebec will not be appealing a judge's decision to throw out the case against five Hells Angels accused of murder and conspiracy.

Earlier this month Justice James Brunton dismissed the case, saying Crown prosecutors had waited an unnacceptably long amount of time to disclose all evidence against the accused.

Claude Berger, Yvon Tanguay, Sylvain and Francois Vachon, and Michel Vallieres were all accused of murder and conspiracy.

They were among the more than 150 people rounded up in 2009 as part of Operation SharQc, and with the dismissals of their case, only two people have yet to have their charges dealt with.

The DPCP is going to order an internal inquiry to determine why it took so long for the Crown to hand over evidence in the case.
