Quebec’s photo radar traffic system is under fire after a Quebec City couple was not allowed to present their defence against a speeding ticket to a judge.

According to a report in Le Journal de Montreal, Denis Tanguay and his wife Diane Chouinard were told by a judge that he would not hear their case, saying the data from the photo radar could not be contested.

According to the Justice Ministry, there has been more than 102,000 disputes for radar camera tickets since the program began in 2009. Not a single one was contested successfully.

Lawyer Avi Levy said he finds the judge’s refusal to hear the couple’s case troubling.

“Basically, photo radars and the radars that they use to catch you speeding on the road are essentially the same device,” he said. “So why is it that a defence is presentable for one and not for the other? There are definitely defences that exist for a photo radar and I just don’t understand why the judge refused to even hear them.”
