A 12-year-old boy accused of shooting and killing his 16-year-old brother will be allowed to attend his brother's funeral.
The boy will be escorted at all times by a pair of workers from the Batshaw Youth Detention Centre while attending the ceremony, which is scheduled for Thursday.
"For compassionate reasons or humanitarian reasons, when a youth is under detention for a sentence or before a trial, they can be brought -- in this case it would be to the funeral," said Crown Prosecutor Marie-Claude Bourassa.
The boy, whose identity must remain secret under court order because he is a minor, is accused of shooting and killing his older brother on Monday Jan. 21, using a handgun that was reportedly stored in a closet.
He has been in police custody ever since.
Lawyers, the youth, and his parents and family were in court Tuesday for a bail hearing, however a final decision was held off, and lawyers will convene again on February 8 in order to set a date for another bail hearing.
The Crown opposes granting the boy bail.
In court on Tuesday the Crown demanded and was granted an order of non-communication between the boy and four people who cannot be identified.
