Quebec will update the highway safety code this fall to deal specifically with devices such as the Apple Watch.
The Surete du Quebec and the Transport Minister don't seem to agree on how the current law applies to the device.
Transport Minister Robert Poeti says it's illegal to use any device that distracts a driver while driving, but SQ spokesperson Guy Lapointe tells CTV that Apple Watches are Bluteooth devices, and since they are not phones, drivers should not be ticketed as if they were.
However Lapointe says a driver could be ticketed under another section of the code dealing with general distraction.
This comes after a Pincourt man was ticketed $120 for changing the music in his car with his Apple Watch on his wrist.
The minister says the point is drivers should just drive.
"If you're reading a texto, if you're reading some different thing on your watch, on your phone, or on your iPad, or anything else, it's distraction. That's clear but if it's not clear we are going to work harder on the new code of security for September," said Poeti.
The SQ spokespeople adds that any device such as a GPS, should not be used by drivers while driving.
