The lawyer for Emma Czornobaj filed a motion Monday to appeal her case.

A jury found Emma Czornobaj, 25, guilty last month of two counts of criminal negligence causing death and two counts of dangerous driving causing death.

The trial heard how Czornobaj stopped her car on Highway 30 in Candiac to help a group of ducklings. A motorcyclist and his teenaged daughter crashed into her car, killing them both.

The motion to appeal said the judge made errors in law.

Among them, it says Justice Eliane Perreault should have instructed the jury take Czornobaj's state of mind into account to assess her level of criminal intent when she stopped. They also argue the verdict was unreasonable given the evidence presented.

Criminal negligence causing death carries a maximum life sentence while the charge of dangerous driving causing death carries a maximum of 14 years in jail.

Her case returns to court on Aug. 8.

An online petition since Czornobaj's conviction has garnered several thousand signatures in her support.
