The lawyer for a topless protester is calling on the courts to throw out the case against her client.

Neda Topaloski was arrested in June 2015 after staging a topless protest at Grand Prix festivities in Montreal.

The women's rights activist is a member of Femen, and frequently bares her breasts to protest inequality.

She is on trial for mischief and disturbing the public.

However Topaloski's lawyer, Veronique Robert, said the case should be dismissed because of how her client was arrested.

Robert contends security guards dragged Topaloski down the street and stepped on her hair before placing her in a vehicle.

Topaloski said she was left with skin abrasions and bruises after the incident.

The two-day trial should wrap up Thursday.
