The penalties for driving while impaired are serious, but what many people don't realize is that a person can be convicted for impaired driving even if they are not drunk when caught driving.

"Some people have a good tolerance, and if they do, they can still be convicted of driving drunk because they're over this magical limit," of 0.08 said Jordan Charness.

"Secondly, if you're a lightweight like me and one strong beverage goes right to your head, but you're nowhere near .08, the law also says you can be convicted of driving while impaired."
