The assault trial for Jonathan Roy, son of Hall of Fame goaltender Patrick Roy, has been postponed.

Roy, who was a goalie for the Quebec Remparts, was charged with assault after skating across the ice in March 2008 to pummel an opposing goaltender during a Quebec Major Junior Hockey League game.

The charges against him came four months after the incident.

Roy appeared in court Monday in Chicoutimi, but Judge Valmont Beaulieu ordered the case postponed until next month.

Steve Magnan, Roy's lawyer, argued that the charges against the 20-year-old should be thrown out.

"We think that Mr. Roy shouldn't have to be on trial. That is why we're asking for a stay of proceedings in this file," Magnan said.

The defence motion states that the decision to apply criminal law to hockey fights was only made several months after the incident.

Roy will return to court Aug. 17 when the judge will hear the defence arguments to have the case dismissed.

The judge will render his decision Sept. 8.
